behind Obamacare?  If you do and don't mind the reading I suggest you go over to The Volokh Conspiracy and start reading.  For the last few days there has been a back and forth between Mr. Hamburger, (Yes that IS his name), Mr. Elhauge, Randy Barnett, Eugene Volokh and many others.  The discussion gets a little dry at times, but the historical information and precedents are very informative.
