Congress Must Act to Stop Biden Administration Abuse of Veterans, FBI NCIS - Ammoland.com
The Biden administration continues to find ways to break faith with America’s veterans. Beyond the disastrous withdrawal from Afghanistan and the unanswered questions left after 13 U.S. service members were killed in a suicide bombing in the final stages of evacuations from Kabul, Afghanistan, White House officials are robbing veterans of the rights they fought to protect.
The Biden administration’s Department of Veterans Affairs has been quietly adding names of veterans who require financial supervision – or a fiduciary – to the FBI’s National Instant Criminal Background Check System (NICS) database as prohibited individuals. This underhanded move might satisfy gun control supporters but is a blatant breach of trust with the very individuals who swore oaths – up to and including their lives – to defend the U.S. Constitution that protects the rights of Americans.
Bureaucrats at the Department of Veterans Affairs are using a little-known rule to skip any judicial proceedings and are doing this without fanfare. The decision to unilaterally wipe away civil liberties has been delegated to unaccountable government employees.
Congressional Action
This is a brazen abuse of bureaucratic authority that must end. American citizens’ Second Amendment rights are protected and can only be stripped for specific instances, including:
- convicted in any court of a crime punishable by imprisonment for a term exceeding one year;
- who is a fugitive from justice;
- who is an unlawful user of or addicted to any controlled substance (as defined in section 102 of the Controlled Substances Act, codified at 21 U.S.C. § 802);
- who has been adjudicated as a mental defective or has been committed to any mental institution;
- who is an illegal alien;
- who has been discharged from the Armed Forces under dishonorable conditions;
- who has renounced his or her United States citizenship;
- who is subject to a court order restraining the person from harassing, stalking, or threatening an intimate partner or child of the intimate partner; or
- who has been convicted of a misdemeanor crime of domestic violence.
Veterans, though, are facing a bureaucratic nightmare. Those veterans needing financial supervision are losing their Second Amendment rights without a court hearing. Several in Congress are fighting back.
Chairman Mike Bost (R-Ill.) introduced H.R. 705, the Veterans 2nd Amendment Protection Act, earlier this year. That bill specifically bars the Department of Veterans Affairs from transmitting veterans’ names to FBI NICS solely for the reason that the veteran has been appointed a fiduciary to assist in managing their financial details.
The legislation was described in a July hearing as ensuring “… that veterans are afforded the same due process that every other American receives before any action is taken that would deprive them of one of the constitutional rights that they fought to protect.”
“For far too long the men and women who have fought to protect every Americans’ constitutional right to bear arms have wrongfully been discriminated against. This Congress, that ends,” said Chairman Bost when he introduced the legislation. “Today I am reintroducing the Veterans 2nd Amendment Protection Act, legislation to ensure that veterans are given the same due process rights as every other American. No VA bureaucrat should have the ability to instantly strip a veteran of their 2nd Amendment rights simply because they use a fiduciary to help them manage their benefits.”

How the ATF is Deceiving Media in their War on Gun Dealers - Ammoland.com
Hallelujah! The legacy media has finally started covering ATF’s unconstitutional war on the country’s gun dealers, which the pro-gun media has been denouncing and warning the public about for more than two years.
The Wall Street Journal published a story Friday morning titled: “Hundreds of Gun Dealers Lose Licenses Under Biden Administration Crackdown.” Nine hours later, FOX News posted their take of the WSJ story titled: “Gun industry cries foul after hundreds of gun dealers lose licenses amid Biden administration crackdown.”
This friends, could be a very good thing.
The more scrutiny the ATF receives, the more difficult it will be for them to continue violating our constitutional rights. But remember that ATF officials are masters of hoodwinking and gaslighting the media and the public. Their responses to the WSJ and FOX show that ATF’s leadership are up to their old tricks. Clearly, they’re trying to downplay the significance of what they’ve already done, and what they continue to do every single day.

Complaint Against DOJ Seeks Documents on NICS Permanent Entry Consent - Ammoland.com
Because the statutorily mandated 20-business day Freedom of Information Act (FOIA) request response time has passed with no acknowledgment, a lawsuit was entered against the Department of Justice Friday in the United States District Court for the District of Columbia. The complaint was filed by attorney Stephen D. Stamboulieh on behalf of this correspondent to compel the Department to produce information regarding “consent to a permanent entry in the National Instant Criminal Background Check System (NICS).”
The purpose of the FOIA request, as elaborated in an August 1 AmmoLand Shooting Sports News exclusive report, was to follow up on information documented in the disallowed Hunter Biden plea deal, in which one of the conditions listed on page 85 of the hearing transcript states:
“Paragraph 9 and its subparagraph are the commitments and undertakings of Biden and that includes not purchasing, possessing, attempting to purchase firearms as that term is defined in the relevant statute during the diversion period, consent to a permanent entry in the National Instant Criminal Background Check System such that he will be denied via NICS if he attempts to legally purchase another firearm.”
The government has no statutory authority to require this.
“The list of prohibited persons [is] established by Congress,” Gun Owners of America noted in a September 2022 letter to Attorney General Merrick Garland and FBI Director Christopher Wray regarding a Bureau-created NICS Indices Self-Submission form:

NJ All-In, Joining CA On Impossible Ammo Microstamping Requirements - Ammoland.com
New Jersey is trying its hardest to become the California of the East Coast – without the good weather, Hollywood, and vineyards. When it comes to gun control, though, New Jersey’s got just about everything California has to offer – even down to the microstamping requirements.
That is, of course, until a federal judge ordered that California couldn’t enforce microstamping mandates earlier this year.
Turns out, it violates the Second Amendment. New Jersey might want to take note.
New Jersey’s Attorney General Matt Platkin announced that his office established standards and an application process for handguns to be included on New Jersey’s microstamping-enabled handgun roster. Gov. Phil Murphy signed a law in 2022 that the state would follow in California’s footsteps to require that handguns be certified that they are equipped with microstamping technology that can regularly impart a code to a cartridge.
There’s just one problem. Every independent study of this nascent “technology” concludes that it does not reliably consistently produce a legible mark on the primer. Put simply, it doesn’t work as advertised. That might be why New York has yet to certify its own microstamping requirement. They’ve been investigating, and so far – nothing. New Jersey will look at the same independent, peer-reviewed studies. And, if they are honest about it, they must conclude it is not feasible.

Everchanging Rules
In an emailed statement to Fox News, ATF said it is merely following the law:
“Federal Firearms Licensees are often our first line of defense against gun crime and are often a source of critical enforcement information that helps law enforcement identify straw purchasers and disrupt firearms trafficking schemes,” ATF Spokesperson Kristina Mastropasqua said. “FFLs that willfully (emphasis mine) violate the law, however, must be held accountable. ATF conducts inspections to ensure compliance with applicable local, state, and federal laws and regulations and to educate licensees on the specific requirements of those laws and regulations.”
For those familiar with Joe Biden’s weaponized ATF, the word “willfully” should jump off the page.

Seattle Mayor ‘Exploits’ Murders; Public Rips Leadership, Policies - Ammoland.com
In the aftermath of a triple murder at a Seattle hookah lounge early Sunday, Democrat Mayor Bruce Harrell was accused of exploiting the crime to push his anti-gun agenda and public reaction has placed the blame on the city’s political leadership and its policies.
Seattle’s problem with crime may be reflective of what is happening in other large cities with liberal municipal governments.
Harrell’s reaction to the slayings was “predictable,” the Citizens Committee for the Right to Keep and Bear Arms said.
In a statement posted on his website, Harrell lamented the “awful epidemic of gun violence” and declared his office is “partnering with legislators at the state level to advance enhanced gun safety legislation and end state preemption over firearms so Seattle can finally set our own laws that keep Seattle neighbors safe.”
Harrell has been a perennial critic of the state’s 40-year-old preemption statute, which has prohibited the increasingly-left city administration from setting its own restrictive gun laws. It was that kind of local control which led the State Legislature in 1983 to adopt the first preemption law, and strengthen it in 1985, the year that the National Rifle Association held its annual convention at the Seattle Center.
