Is New York’s Ammo Background Check System a Legal Snare Being Set for Gun Owners - Ammoland.com
Keene Valley, NY – New York’s controversial ammunition background check system, already a subject of frustration for gun owners and dealers, is under fire once again. This time, it’s not just about delays and fees but a new procedural twist that one prominent attorney has called “entrapment.”
Last week, federally licensed firearms dealers in New York discovered a surprising update: customers could purchase ammunition twice a month under a single background check. While this may seem like a convenience for buyers, attorney, and firearms compliance expert, Paloma Capanna sees it as a legal trap. She argues that the change directly contradicts state law, which requires a background check for EACH and EVERY ammunition purchase.
“The New York State Police are essentially telling dealers to break the law,” Capanna said. “This opens them up to fines, misdemeanor charges, and even losing their licenses.”
Entrapment or Error?
Capanna’s sharp criticism is grounded in legal concerns. Under the 2013 SAFE Act, a law introduced under former Governor Andrew Cuomo, ammunition purchases in New York were tied to strict background check requirements. However, the system wasn’t fully operational until Governor Kathy Hochul launched it in 2023. Since then, it’s been plagued by delays, hefty fees, and now, what Capanna calls a potential systemwide violation.

New York Bill Would Let Police ‘Briefly Seize’ Firearms During Domestics - Ammoland.com
Police in New York want the legal ability to seize firearms during a domestic violence call – even if no arrests were made. However, instead of going through normal legal channels and obtaining a search warrant or court order, police just want the legal ability to take the guns on their own.
New York State lawmakers plan to reintroduce a bill during the next legislative session that will go farther than the state’s Safe Homes Act of 2020, which allows officers to seize firearms found during a consensual search when police respond to a domestic dispute.
New York State Senator Peter Harckham, a Democrat from Westchester County, has sponsored a bill that would “mandate” officers to confiscate all firearms left out in the open during a domestic call.
“This is not gun control, this is gun safety; and this is domestic safety,” the senator told Spectrum News. “This is keeping the victims of domestic violence alive. We had two fatalities through domestic violence and firearms in my district in the last month. This is very real. This is very deadly and this is not a permanent seizure.”
Senator Harckham’s bill would allow police to keep the seized weapons for five days – most likely to seek restraining orders or other legal options – before returning them to their rightful owners. Also, police would likely extend this five-day time limit as needed.

Pennsylvania Supreme Court Denies Attempt to Override Preemption - Ammoland.com
The Pennsylvania Supreme Court knocked down the City of Philadelphia’s challenge to the Commonwealth’s firearms preemption law.
Philadelphia sued the Commonwealth of Pennsylvania, claiming that the Keystone State’s firearms preemption law was unconstitutional, meaning that the city could create its own gun regulations. The claim is that the Pennsylvania Legislature is not doing enough to curb “gun violence,” and therefore, the city has every right to enact its own regulations on guns.
Philadelphia has seen a rise in violence in recent years and blames the proliferation of homemade firearms made from kits and on 3D-printers for the City of Love’s violent crime problems. However, others blame the Philadelphia District Attorney’s Office led by DA Lawrence S. Krasner. Mr. Krasner is a controversial prosecutor whose campaign was largely funded by George Soros-connected groups. He has been accused of being soft on crime by prioritizing “social justice” over dealing with the city’s crime problem. He has worked to free Black Lives Matter and Occupy Philly Protestors. The DA has worked with one of the most controversial groups in the state, Decarcerate PA. Decarcerate PA’s goal is to shut down prisons within the state and prevent the incarceration of criminals within the Commonwealth.
Philadelphia claimed that “gun violence” is a public health crisis, claiming they had a right to regulate firearms. Municipalities across the country have used this argument to try to get around state gun preemption laws and the United States Constitution. In New Mexico, when Governor Michelle Lujan Grisham attempted to ban the carrying of guns in the Albuquerque area. The courts rejected her public health order.
