Exclusive: FOIA Evidence Has Brady, Everytown, & Giffords Targeting ATF’s Relationship With The Gun Industry - Ammoland.com
SPRINGFIELD, Virginia — A new Freedom of Information Act (FOIA) response from the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) supplied to AmmoLand News by Gun Owners of America (GOA) shows more evidence of anti-gun groups weaponizing the FOIA process against the firearms industry.
Pro-gun groups like GOA and pro-freedom publications like AmmoLand News have used FOIA requests to keep government organizations like the ATF and FBI in check. By exposing these organizations’ inner workings and abuses, we have affected change and helped Congress call the ATF and FBI to the carpet for their misdeeds.
In past articles, AmmoLand News has reviewed the FOIA request of anti-gun groups to determine how these groups use FOIA requests to their advantage. Studying past FOIA requests and looking into the Brady Organization’s continuing legal education (CLE) classes, I have come to the conclusion that Brady is most likely using FOIA results to try to find ways around the Protection of Lawful Commerce in Arms Act (PLCAA).
The PLCAA protects American gun companies from frivolous lawsuits.
There are exceptions to the PLCAA for things like defective products, breach of contract, criminal misconduct, and other actions, such as selling a gun they knew would be used in a crime. Proximate cause is another way to get around the PLCAA. Proximate cause refers to a primary cause of an incident that sets everything into motion. Anti-gun groups have used FOIA results to void PCLAA protections.
Now a new FOIA request shows anti-gun groups are still weaponizing the FOIA process but are also targeting other organizations and the ATF for working with the industry.
Brady United, Everytown for Gun Safety, and Giffords filed FOIA requests. In addition to the anti-gun organizations filing FOIA requests, the anti-gun publication The Trace also requested information from the ATF through the FOIA process. Much like the last batch of FOIA requests, the groups target federal firearms licensees (FFLs) for ATF inspection violations. The groups first filed FOIA requests to determine what FFLs have been inspected by the ATF Industry Operations Inspectors (IOI) over the past three years. Then the groups requested information on inspection results, violations, and penalties. These include gun shops in multiple states and around cities like Uvalde, TX.

PA’s Insane Ammunition Registration Database, Wants All Your Ammo to Have Separate Serial Numbers - Ammoland.com
Proposed Pennsylvania House Bill 586, introduced on March 20, 2023, proposes significant changes to ammunition regulations that would impact law-abiding gun owners in the state. The bill, which was introduced by 12 state Democrats, including prime sponsor Representative Stephen Kinsey, seeks to give the Commissioner of Pennsylvania State Police and the Secretary of Revenue the power to enforce the new rules and collect a tax on ammunition to fund the changes.
Encoded Ammo Database, Pennsylvania House Bill 586
The bill would create an “encoded ammunition database,” which would contain comprehensive records of all ammunition sold or purchased, including details from the manufacturer, seller, and purchaser. The National Shooting Sports Foundation (NSSF), the trade organization for the shooting sports industry, has raised concerns about exactly this type of database in a recent Bullet Serialization Fact Sheet [embeded below], noting that it could have negative implications for public safety and law enforcement.
The bill has several provisions, including a requirement that all ammunition sold in Pennsylvania must be encoded with multiple serial numbers. This means that a manufacturer must add individual serial numbers to all ammunition provided for retail sale in a manner yet to be established by the Pennsylvania State Police commissioner. Each bullet would have a unique serial number located at its base, inside the cartridge casing, and outside the box of ammunition.

NRA Shows Up Late & Screws ‘Freedom To Carry’ Bill for NC Gun Owners - Ammoland.com
Progress on House Bill 189, now named “Freedom to Carry NC,” stalled on Wednesday after the NRA reportedly came out in opposition to the bill. NRA lobbyist DJ Spiker, who had been utterly absent from the debate over permitless concealed carry (and rarely seen at the legislature), showed up at the Judiciary 2 Committee meeting, which passed HB 189 on Tuesday, and began complaining about the bill’s contents.
To satisfy Speaker Tim Moore’s requirement to move the bill, the latest incarnation of HB 189 contains a nominal training requirement to establish that concealed carriers know relevant state laws. The training requirement can be satisfied by courses from the NRA, USCCA, or an online course to be established by the North Carolina Criminal Justice Education and Training Standards Commission. There will be no permit, no live fire training, no requirement to carry proof of training, nor any central repository or database of who has or has not taken a course.
NRA “not invented here” syndrome
Spiker reportedly complained to bill sponsor Rep. Keith Kidwell, that due to the training requirement, it was no longer a “true” constitutional carry bill. In truth, HB 189 has always been a hybrid bill in that it offered permitless carry only to those who would otherwise qualify for a permit. Its progenitors stretch back to 2017 with HB 69, sponsored by Rep. Larry Pittman, and HB 746, sponsored by Rep. Chris Millis, both of which contained language similar to HB 189. Despite the fact that HB 746 passed the NC House, sponsors report that the NRA has never been active in the constitutional carry debate.

How Sgt. Daniel Perry’s Social Media Led to His Conviction in Politically Biased Austin, Texas - Ammoland.com
U.S.A. – On July 25, 2020, Sgt. Daniel Perry unexpectedly turned into a Black Lives Matter protest a little before 10 p.m. on Congress Avenue in Austin, Texas. His right of way was blocked by protestors who surrounded the vehicle, beat on, and kicked it.
Garret Foster, one of the protestors, openly armed with an AK47-style semi-automatic rifle, approached Perry’s driver’s side window and motioned for him to roll down the window.
After Sgt Perry rolled down the window, He says Foster raised the rifle towards him, and he fired in self-defense. Another protestor fired at Perry’s vehicle as protestors scattered, and he drove out of the danger zone. Perry immediately called 911 and told police what had happened. At this link, defense attorneys give Perry’s version of events.
The initial investigation by Austin police found the case was one of self-defense. Foster appears to have been masked when he approaches the car. No one was arrested or prosecuted. Sgt Perry fully cooperated with the police.
On November 3, 3030, Soros-Funded José Garza was elected the Travis County District Attorney. Austin is in Travis County.
In 2021, Garza convened a grand jury and obtained controversial indictments against Perry, in which a Police Detective, David Fugitt complained of Garza’s bias against Perry.
